ESTATE SALE Terms  

This document is intended to be a legally binding contract and contains all of the terms, conditions and provisions of the agreement between the parties. You have requested that we sell your personal property at an Estate Sale and demolition sale and we have agreed to do so upon the following conditions:  
Payment to Consignor: Payment to consignor for items sold will be made within 20 business days after the items are sold.   
Services Rendered: We will conduct the sale in a professional and efficient manner.  Unless you instruct us otherwise, we will conduct the sale with two objectives:  1) To sell every available item; and 2) maximize the proceeds from the sale.  During the course of the sale, we may negotiate prices with customers and accept bids as we consider appropriate in order to achieve the two objectives stated above. We incur all costs associated with the Advertising and Staffing of the Estate Sale.  
Compensation:  For our services in selling your personal property of fixtures at an estate/demolition sale, we will be entitled to retain from proceeds as our compensation a commission of 35% on all your items sold. All items or possessions at the Location, unless otherwise agreed or marked “not for sale”  At the time this Contract is executed, shall be subject to sale by Atherton Antiques & Consignments.  
Setup & Organizational Fee:       
Sale: At present we anticipate that your personal property will be sold at a sale scheduled for                                              . Additional items may be sold at the sale to enhance the appearance and attract a larger customer base. Atherton Antiques & Consignments will 
  
be responsible for moving these items. These furnishings and profits from them belong to Atherton Antiques.   
Cost of clean-up labor is assessed at $125/ Hour. This can be decided before or after the sale.  
Access to the property will be necessary ASAP for setup and staging. Atherton Antiques & Consignments, Christal Hassun and all associates are to be held harmless from all claims resulting from theft, damage, injury or destruction.
